Introduction and Acknowledgment

Welcome to Foodiy! These terms and conditions govern your use of our platform, including the Foodiy app and website. By accessing or using our services, you agree to comply with these terms. If you do not agree, please refrain from using Foodiy.

This Terms is an electronic record in terms of the Information Technology Act, 2000 and rules made thereunder as applicable. The Terms is published in accordance with the provisions of Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and does not require any physical, electronic, or digital signatures.

1. Definitions and Interpretation

Unless the context otherwise requires, for these Terms, the following terms shall have the meaning ascribed to them hereunder:

  • Applicable Law: means all laws, ordinances, statutes, rules, orders, decrees, injunctions, licenses, permits, approvals, authorizations, consents, waivers, privileges, agreements, and regulations of any governmental authority/court of law having jurisdiction over the relevant matter including any interpretations thereof, in effect, including but not limited to, Information Technology Act, 2000 and the rules made thereunder, Digital Personal Data Protection Act, 2023;
  • Content: shall mean any content, including but not limited to, pictures, messages, videos that may be shared, uploaded and posted on the Platform by the User;
  • Materials: includes (i) the text, software, scripts, graphics, photos, sounds, music, videos, audio-visual combinations, interactive features and other materials and (ii) comments and Content that You may contribute in any manner on a particular section of Platform via features or functionalities to the Platform;
  • User Account: means the personal online account created by the User to gain access and use the Platform;

2. User Account and User Obligations

The User may view and/or access the Services or the Platform by simply visiting the Platform and clicking on relevant pages that include, articles, newsletters. Furthermore, to access certain other Services, the User must first create a User Account with the Platform by providing details, including Personal Data as may be required by the Company and provided for in the Privacy Policy.

2.1 Account Responsibilities

  • Account Information: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
  • Age Requirement: You must be at least 13 years old to use Foodiy. If you are under 18, you must have permission from a legal guardian. EU users under 16 require parental consent as per GDPR.
  • Information Accuracy: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.2 Prohibited Activities

You agree not to engage in any of the following activities:

  • Unauthorized Access: Access or attempt to access the Platform by any means other than through the interface provided by Foodiy.
  • Harmful Content: Upload, post, or transmit any content that is inaccurate, false, harmful, obscene, pornographic, defamatory, racist, violent, offensive, harassing, or otherwise objectionable.
  • Malicious Software: Upload files that contain viruses, trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software that may damage our systems.

3. Services Provided on the Platform

3.1 You acknowledge that the Platform allows You to avail the following Services including:

  • Content Access: The Platform provides easily accessible content, connections and communications that powers brand and business objectives generated, developed or produced by the Company or aggregated, obtained and/or licensed through third party sources.
  • Support Services: Promptly and efficiently responding to Your queries or issues relating to Your User Account and the Services availed through the Platform.

4. Subscription Fee

4.1. The subscription fees of each of the Services shall be displayed on the Platform. The prices mentioned at the time of subscribing the Service shall be the price charged at the time of providing the Service. All the Services listed on the Platform will be available for subscription at Indian Rupees.

4.2. The Users will be informed about any additional charges, fees, and costs if any that may be levied on the subscription for the Services on the Platform at the checkout page during a transaction.

5. Payment Terms

5.1. The information relating to the accepted payment methods on the Platform shall be displayed during the purchasing process. To the extent permitted by Applicable Law and subject to the Privacy Policy, You acknowledge and agree that the Company may use certain third-party vendors and service providers, including payment gateways, to process payments and manage payment card information.

5.2. Except to the extent otherwise required by Applicable Law, the Company is not liable for any payments authorized through the Platform using Your payment details. Particularly, the Company is not liable for any payments that do not complete because:

  • Your bank account or any other payment did not contain sufficient funds to complete the transaction;
  • You have not provided the Company with correct payment details;
  • Your payment card has expired;
  • Circumstances beyond the Company's reasonable control prevent the execution of the transaction.

6. Refunds and Cancellations

6.1. Refunds

The policy for refund of monies with respect to cancellation of subscription or for any other purpose, shall be communicated to the User, from time to time, through the Terms, or push notifications on the Platform, or any other mode of communication as specified in this Terms or as determined by the Company.

6.2. Cancellations

You may cancel a subscription without charge at any time before the Company accepts the subscription. The cancellation policy including with respect to cancellation fee with respect to the subscription accepted by the Company, shall be communicated to the User, from time to time.

7. Proprietary Rights and Intellectual Property Rights

7.1. User acknowledges and agrees that this Platform and the Content posted herein, which shall include but shall not be limited to pictures, branding, text, Content, graphics, designs, brand logos, audio, video, interfaces and/or any other information, or any Intellectual Property Rights is protected and is owned, controlled or licensed by or to Company.

7.2. You agree not to:

  • Modify, publish, copy, transmit, transfer, sell, reproduce, create derivative works from, distribute, frame, or in any way exploit any of the content on our platform;
  • Remove, conceal or obliterate any copyright or other proprietary notice;
  • Use any framing techniques to enclose any trademark or logo;

8. Privacy Policy

8.1. Company is committed to protecting Your Personal Data. Our Privacy Policy available on the Platform provides details about the information we collect about You, how we use it and how we protect it. It also explains Your rights and how to contact us if You have questions about how we use Your information.

9. Disclaimer

You expressly understand and agree that, to the maximum extent permitted by Applicable Law:

  • The Platform is provided on an "as is" basis without warranty of any kind, express, implied, statutory or otherwise.
  • Company makes no warranty that the Platform will meet Your requirements or be available on an uninterrupted, secure, or error-free basis.

10. Termination

We may suspend or terminate your access to Foodiy if you violate these terms or engage in unauthorized activities. Upon termination:

  • Your right to access and use the Platform will immediately cease
  • Your User Account will be disabled
  • Any pending transactions may be immediately terminated
  • We may delete any content or information you have posted on the Platform

11. Governing Law

These terms are governed by and construed in accordance with Indian laws, GDPR, and other relevant regulations. Disputes will be resolved in courts with appropriate jurisdiction.
